Please read these Terms of Service ("Terms") carefully before using the DesignSQL website and services.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Description of Service

DesignSQL provides a web-based platform for designing database schemas and entity-relationship diagrams (ERDs). Our service includes a FREE plan (with limits on projects and tables) and paid plans (PRO and TEAM) which offer unlimited resources, version history, and team collaboration features.

2. User Accounts

• Authentication: Accounts are created and accessed via Google OAuth. You are responsible for maintaining the security of your Google account.
• Account Responsibility: You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
• Communications: We communicate important service updates, team collaboration invitations, and critical billing or subscription-related updates via email. It is your responsibility to regularly check your email for important account information.
• Paid Accounts (PRO & TEAM): Premium features and team collaboration capabilities are accessible only to users with an active paid subscription.

3. Subscriptions and Payments

• Billing: Subscriptions are billed on a recurring monthly basis. Payments are processed securely via Lemon Squeezy.
• Cancellations: You can cancel your subscription at any time through your dashboard settings. Access to paid features will continue until the end of your current billing period.
• Refunds: We do not provide refunds or credits for any partial-month subscription periods or unused time. Except as required by law, all paid subscription fees are strictly non-refundable.

4. Intellectual Property and Data Security

• Your Content: You retain all ownership rights to the diagrams and schemas you create using DesignSQL. We do not claim any ownership over your user-generated content.
• Data Security: We employ server-side encryption (AES-256-GCM) to safeguard your diagrams saved on our platform. While we prioritize the security of your data, you are encouraged to maintain local backups of critical designs.
• Our Platform: DesignSQL and its original content (excluding user diagrams), features, and functionality are and will remain the exclusive property of DesignSQL. Our platform is protected by copyright, trademark, and other laws.

5. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

6. Limitation of Liability

In no event shall DesignSQL, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content.

7. "As Is" and "As Available" Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Indonesia, without regard to its conflict of law provisions.

9. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
